Why KYC and KYB matter
Every regulated financial relationship in the US starts with a Customer Identification Program (CIP) — the BSA-mandated requirement to identify and verify the customer. KYC is the consumer flavor; KYB is the business flavor, which also requires beneficial-ownership identification under the Corporate Transparency Act and 31 CFR 1010.230.
For a fintech, getting KYC/KYB right is the price of admission. Getting it wrong is the fastest route to a sponsor-bank offboarding, an OFAC penalty, or a consent order.
When the rules bite hardest
- Onboarding — identity verification (name, DOB, address, ID number), document checks, liveness, beneficial-owner attestation for businesses
- Ongoing monitoring — sanctions rescreens, transaction monitoring, periodic refresh of customer information
- Enhanced due diligence — for higher-risk customers (PEPs, certain geographies, certain industries)
Common pitfalls
- Confusing KYC with identity verification. Identity verification is a component of KYC. KYC also includes risk profiling and ongoing monitoring.
- Stale beneficial ownership. Companies change. You owe periodic refresh.
- Vendor-only programs. Outsourcing KYC to a vendor doesn't outsource the liability — the sponsor bank still owns the program.
KYC/KYB is not a checkbox; it is the perimeter of your regulatory posture.
